As a result of these Business Activities, GRUPO SIMCA collects and/or has access to the personal data described in Section 4 of this Notice, belonging to individuals who are interested in acquiring or have initiated the acquisition process of one or more Units (the “Personal Data”). If you have started or will start the process of acquiring a Unit (the “Transaction”) and, as a result, have provided or will provide any Personal Data to GRUPO SIMCA physically, by email, or through this portal, you will be considered the “Data Subject” for the purposes of this Privacy Notice. PERSONAL DATA CONTROLLER In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “Personal Data Law”), GRUPO SIMCA is the party responsible for obtaining, accessing, using, handling, managing, transferring, disposing, disclosing, or storing (actions collectively referred to as “Processing” in this Notice) the Personal Data of the Data Subject. CONFIDENTIALITY COMMITMENT GRUPO SIMCA commits to the Data Subject to protect their Personal Data under the terms of the Personal Data Law and this Notice. Consequently, and except for Authorized Transfers (as defined in Section 7 of this Notice), GRUPO SIMCA will not transfer the Data Subject’s Personal Data to any Third Party (as defined in Section XVI, Article 3 of the Personal Data Law, with the understanding that “third parties” do not include employees, shareholders, directors, managers, legal representatives, advisors, and other representatives of GRUPO SIMCA), including Financial Data and Sensitive Data (as defined in Sections 4.1.1 and 4.1.2 of this Notice, respectively), without the prior consent of the Data Subject. Furthermore, GRUPO SIMCA commits to Processing the Data Subject’s Personal Data in accordance with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility. Phone number vi. Email address Legal Entity: i. Corporate name ii. Name of legal representative iii. Articles of incorporation and power of attorney 4.1.1. Financial Data When the Data Subject makes full or partial payment of the Transaction using a credit or debit card (the “Card”), they will provide GRUPO SIMCA with the following information related to the Card (the “Financial Data”): i. Credit or debit card number ii. Issuing bank iii. Name of the cardholder iv. Card expiration date
